These terms are an agreement between you and BeyondReviews, operated by Simon Folmann in Denmark ("BeyondReviews", "we", "us"). They apply to the BeyondReviews app for Shopify (the "App"), the storefront review widget (the "Widget"), and this website (together, the "Service"). By installing the App, submitting a review, or using the website, you accept them.
The terms come in three parts: Part A applies to everyone, Part B to merchants who install the App, and Part C to reviewers who submit reviews.
Part A · Everyone
A1. Accounts and accuracy
Information you give us must be accurate and kept current. You are responsible for activity under your account and for keeping access to it secure. You must be at least 16 to use the Service.
A2. Acceptable use
You may not use the Service to:
- publish content that is unlawful, defamatory, infringing, hateful, or sexually explicit, or that contains another person's personal data without permission;
- create, solicit, or publish fake, incentivised-but-undisclosed, or misleading reviews (see B4);
- probe, scrape, overload, reverse engineer, or interfere with the Service, or use its content for text and data mining or model training without our written permission;
- transmit malware or attempt to access data that is not yours.
A3. Intellectual property
The Service, its software, design, and content (other than user content) are owned by BeyondReviews and protected by law. These terms give you no rights in them except the right to use the Service as intended.
A4. Privacy
The Privacy Policy explains what data we handle and why. For merchants, the Data Processing Addendum is part of these terms and governs our processing of your customers' personal data.
A5. Disclaimer and liability
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties, and our total liability for all claims in any 12-month period is limited to the fees you paid us in that period (or DKK 500 if you paid none). We are not liable for indirect or consequential losses, including lost profits, revenue, or data. Nothing in these terms limits liability that cannot lawfully be limited, including liability for gross negligence, wilful misconduct, or, for consumers, mandatory consumer protections in their country of residence.
A6. Changes, governing law, contact
We may update these terms; for material changes affecting merchants we give at least 30 days' notice by email or in-app notice, and continued use after that constitutes acceptance. These terms are governed by Danish law, and disputes belong to the courts of Denmark, except that consumers keep the protection of the laws of their home country and merchants and we may seek injunctive relief anywhere. Part B · Merchants
B1. The service
The App collects reviews from your customers, verifies them against your order data, lets you moderate and reply to them (with optional AI-drafted reply suggestions that you approve before publishing), and displays them on your storefront with structured data so they can be found by search engines and answer engines.
B2. Fees and billing
Fees are charged through Shopify's billing system at the prices shown on our App Store listing, in advance, per billing cycle. If we offer a free trial and you do not cancel before it ends, billing starts automatically. Fee changes take effect at your next billing cycle, with at least 30 days' notice. Except where the law requires otherwise, payments are non-refundable; uninstalling the App ends billing at the end of the current cycle.
B3. Your legal compliance
You are responsible for your own compliance with the laws that apply to your store, including review, consumer protection, marketing, and data protection law in the places you sell. In particular, you warrant that:
- you have a lawful basis, and where required consent, for us to email your customers review requests on your behalf (e.g. GDPR and the ePrivacy rules, CAN-SPAM, CASL);
- your own privacy policy tells your customers that you use BeyondReviews to collect and display reviews, and lists us as a processor or subprocessor of their data;
- you will not submit data to the App that you are not allowed to share with us, and you will not submit sensitive data (health, financial account numbers, government identifiers, or data about children) in any free-text field.
B4. Review authenticity
Trust in reviews is the product. These rules are not negotiable:
- The "Verified purchase" badge is applied only by the App, based on matching a review to a real order. You cannot add it, buy it, or influence it.
- Star ratings cannot be edited, by you or by us. A reviewer may amend their own review.
- You may not write reviews of your own products, have employees or agents do so, or pay for reviews. Incentivised reviews (e.g. in exchange for a discount) are permitted only where the incentive is offered for a review regardless of sentiment and the review is labelled as incentivised.
- You may moderate reviews for the reasons in A2 (unlawful or abusive content), but you may not suppress reviews merely because they are negative while publishing positive ones from the same period in a way that misleads shoppers.
Breach of this section is grounds for immediate suspension. We may also be required to act by platform rules or law (for example the FTC's rule on fake reviews and the EU's consumer protection rules on review authenticity).
B5. Content licences
You grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, and process your store's content (product data, branding shown in the Widget, your replies to reviews) as needed to provide the Service and to operate, secure, and improve it. We grant you, for as long as you use the Service, the licence we receive from reviewers (C2) so that you can display their reviews on your storefront and in your marketing, subject to the same lifecycle rule: if a review is deleted, your licence to it ends.
B6. Data protection
For your customers' personal data, you are the controller and we are your processor under the Data Processing Addendum, which is incorporated into and forms part of these terms. When you uninstall the App, Shopify issues its shop redaction instruction to us 48 hours later, and we delete your store's data, including your customers' data, within 30 days of receiving it, with encrypted backups purged within 90 days (DPA section 9). We honour Shopify's customer data request and redaction webhooks for your store automatically.
B7. Suspension and termination
You can stop using the Service at any time by uninstalling the App. We may suspend or terminate the Service for breach of these terms, where required by law or by Shopify, or on 30 days' notice if we discontinue the Service. Sections A3, A5, B3, B8, and the post-termination parts of B5 and B6 survive.
B8. Indemnity
You will defend and indemnify us against third-party claims arising from your store's content, your breach of B3 or B4, or your unlawful use of the Service, except to the extent the claim was caused by our breach of these terms.
B9. Service commitment
We aim for the Widget and review collection to be available 99.9% of each month, measured excluding scheduled maintenance and factors outside our control (including Shopify outages). The Widget is designed to fail silently: if it cannot load, it renders nothing rather than slowing or breaking your storefront.
Part C · Reviewers
C1. Your review
A review must be your honest opinion of your own experience with the product or store. Do not submit content you do not have the right to share, and do not include other people's personal data. We and the merchant may decline to publish, or may remove, content that breaches A2; neither we nor the merchant is obliged to publish any review.
C2. Your licence to us and the merchant
You own your review. By submitting it, you grant BeyondReviews and the merchant whose store you reviewed a worldwide, non-exclusive, royalty-free, transferable licence to host, reproduce, adapt for formatting, publish, and display it, including in the merchant's marketing and in search and answer engine results, in connection with the Service. If you amend your review, the licence covers the amended version; if you delete it, the licence ends, except for copies already made by third parties (such as search engine caches) that we do not control.
C3. Public display and your name
Published reviews are public. You choose how your name appears (full name, first name and initial, or anonymous). Your email address and order details are never shown publicly.
C4. Amending or deleting your review
You can request an amendment or deletion at any time through the link in any email we send you, or by writing to [email protected]. Merchants cannot edit your text or your star rating; they can only suggest an edit, which takes effect only if you approve it.
C5. No payment for reviews
We never pay reviewers. If a merchant offers an incentive, it must be offered for a review regardless of sentiment, and the review will be labelled as incentivised.
